1. BACKGROUND

About this Privacy Policy

Wes Davidson Real Estate Pty Ltd is a leading real estate agency servicing Horsham and the surrounding suburbs.

In this Privacy Policy, “we”, “us” and “our” refers to Wes Davidson Real Estate Pty Ltd ACN 060 631 156 and “you” and “your” refers to any individual about whom we collect personal information.

We are committed to protecting your privacy. This Policy is designed to give you a greater understanding of how we collect, use, process, disclose and otherwise handle personal information submitted to us, whether offline or online).

Other terms and conditions may apply to you such as:

  •  the privacy terms and conditions contained in contractual arrangements we may have with you; and
  • the collection notices and privacy statements which may be provided to you at the time your personal information is collected.

What is personal information?

In general terms, ‘personal information’ is defined in the Privacy Act 1988 (Cth) (Privacy Act), and means information or an opinion about an identified individual or an individual who is reasonably identifiable, whether the information is true or not and whether the information or opinion is recorded in a material form or not.

In this Privacy Policy, whenever we use the term ‘personal information’, we are referring to this legal definition.

 
Our obligations

We are required to comply with the Australian Privacy Principles (APPs) in Privacy Act 1988 (Cth) (Privacy Act). The APPs regulate the manner in which personal information is handled throughout its life cycle, from collection to use and disclosure, security, accessibility and disposal.

The Privacy Act also includes a data breach notification regime, which requires us to address data breaches involving personal information held by us.

 

2. WHAT WE COLLECT

General

The type of personal information that we collect about you depends on the type of dealings you have with us. We have set out some of the different forms of information that we may collect below:

• your working eligibility rights;

• your suitability for the role you are applying for;

• pre-employment medical assessment results;

• work performance and training details;

• superannuation fund details;

• criminal history record;

• credentialing information including licences and professional registrations, accreditations and working with children checks;

• emergency contact details;

• details about your referees; and

• income and entitlements.
We may collect this information:

• if you apply for a position with us;

• directly from you, where you’ve included this information in an application for a rental property; and

• from third parties, including your employer.

We may also collect other types of information, which we have summarised below:

If you do so, you agree that you have received permission from these individuals for us to collect, use, and share, their personal information in accordance with this Privacy Policy.

Sensitive information

Sensitive information is a subset of personal information that is generally afforded a higher level of privacy protection, such as health information. We only collect sensitive information where it is reasonably necessary for our functions or activities and either:

  • the individual has consented; or
  • we are required or authorised by or under law (including applicable privacy legislation) to do so.

Collection of information other than personal information through our website

When you visit our website some of the information that is collected about your visit is not personal information, as it does not reveal your identity.


Site visit information

For example, we record your server address, the date and time of your visit, the pages you visited, any documents you downloaded, the previous site you visited and the type of device, browser and operating system you used.

We use and disclose this information in anonymous, aggregated form only, for purposes including statistical analysis and to assist us to improve the functionality and usability of our website. You are not individually identified, however, we reserve the right to use or disclose this information to try to locate an individual where we reasonably believe that the individual may have engaged in any unlawful or inappropriate activity in connection with our website, or where we are otherwise required or authorised by law to do so.


Cookies

A cookie is a small string of information that a website transfers to your browser for identification purposes. The cookies we use do not identify individual users, although they do identify the user’s internet browser.

We use cookies to hold anonymous session information. This information is used to personalise your current visit to the website, for example, to allow the website to remember who you are by keeping server variables linked to your session.

3. CAN YOU DEAL WITH US WITHOUT PROVIDING YOUR NAME? 

Where possible and lawful, you may interact with us anonymously or using a pseudonym (a fictitious name). For example, if you contact us with a general question or query, we will not record your name or other details unless we need it to adequately respond to your query.

However, for many of our functions and the services we provide, we need information about you as it may not be practicable for us to deal with you anonymously or pseudonymously on an ongoing basis when providing our services.

If you provide incomplete or inaccurate information to us or withhold personal information from us we may not be able to provide you with the services you are seeking.

 

4. COLLECTION NOTICES

Where we collect personal information about you, we will take reasonable steps to provide you with certain details about that collection (such as the purpose for which we are collecting the information and the type of third parties to which it is usually disclosed). We will generally include this information in a collection notice.

Collection notices provide more specific information than this Privacy Policy. The terms of this Privacy Policy are subject to any specific provisions contained in collection notices. We encourage you to read those provisions carefully.

 

5. WHY WE COLLECT PERSONAL INFORMATION

The primary purpose for which we collect, hold, use and disclose personal information will depend on who you are and your interaction with us.

We have summarised the types of purposes for which we may collect your personal information:

To manage your working relationship with us (including when you are a contractor)We may collect, store and use your personal information to assess your suitability for a position with us, and, if you successfully join us, to manage your working relationship with us.

We may collect, store and use your personal information for administration and management purposes.
To do business with youWe may collect, store and use your personal information about you if you interact with us on a commercial basis (such as if you are a referring
healthcare or wellness practitioner, specialist, service provider, contractor or supplier to us), or you otherwise interact with us on a commercial

• test and train our technology systems;

• test, train, improve and develop our technology systems, products and services;

• undertake risk and operational management processes;

• investigate any incidents that may occur (both in relation to cyber security, as well as any health and safety incidents that occur at our premises);

• handle and respond to any complaints made;

• maintain the security of our facilities; and/or

• assist with service development, to test the effectiveness and customer satisfaction of our products and services, improve the way we provide services to you, and for other quality assurance and compliance purposes.
To promote or advertise the services of our related entities, business partners, contractors, associates and other third partiesWe may collect, store and use your personal information to promote or advertise our services or facilities or the services of our related entities, business partners, contractors, associates and other third parties, as further described in section 8 of this Privacy Policy.
To assist with any business, share sale or corporate restructureWe may collect, store and use your personal information for the purpose of considering, facilitating or implementing a transfer or sale of all or part of our assets or business or if we undergo any other kind of corporate restructure, acquisition or sale or proposal for any such transaction.
6. DO WE SHARE YOUR PERSONAL INFORMATION OVERSEAS?

We generally collect your personal information in Australia. However, some of the organisations we may disclose your personal information to are located outside Australia, including in the United States and the United Kingdom. These recipients include our service providers who may handle, process or store your personal information on our behalf.

For example, we may share your personal information with service providers who assist us with storing our data on secure data storage servers, or with improving our services (by analysing data, and conducting member satisfaction enquiries).

We only ever share your personal information outside of Australia where we are permitted to do so under the Privacy Act and applicable privacy laws.

There are other circumstances where we may disclose your personal information to an overseas recipient. For example, where you have provided your consent or we are otherwise permitted to do so under other relevant laws.

 

7. DIRECT MARKETING

You consent (until such time as you opt out, as described below) that we may use your personal information to let you know about us and our services (including new listings and off-market opportunities) either where we have your express or implied consent, or where we are otherwise permitted by law to do so. We may contact you for these purposes in a variety of ways, including by mail, email, SMS, telephone and online advertising.


Opting out

Where you have consented to receiving communications from us, your consent will remain current until you advise us otherwise. However, you can opt out at any time, by:

  • contacting us;
  • advising us if you receive a marketing call that you no longer wish to receive these calls; or
  • using the unsubscribe facility that we include in our commercial electronic messages (such as emails and SMSs).

Once you do this, we will update your profile to ensure that you don’t receive further marketing messages.


Important points regarding opting out

Importantly, regardless of whether you opt out from receiving any or all direct marketing communications, we will still communicate with you if we are required by law to provide you with information, or in relation to the services we are providing you with (for example, sending you an invoice in relation to a provided service or sending a SMS reminder about your appointment). 


Third-party marketing

We will get your express opt-in consent before we share your personal data with any organisation outside Wes Davidson Real Estate for marketing purposes.


Notification of source

If we have collected the personal information that we use to send you marketing communications from a third party (for example, a direct mail database provider), you can ask us to tell you our source of information, and we will do so, unless this would be unreasonable or impracticable.

 

8. WHO WE MAY SHARE YOUR PERSONAL INFORMATION WITH

We may share your information with third parties:

  • for the reasons for which we collect, store and use that information (see above);
  • for other purposes explained at the time we collect your personal information; or
  • where we are otherwise allowed or required to do so under law.

• trades, contractors and related service providers involved in property management or maintenance (inferred from similar arrangements for utilities providers);

• mail houses, data processors, debt collection agencies;

• IT service providers and third party storage providers;

• IT support services;

• financiers and professional consultants/advisers where necessary to perform obligations under agreements; data analysis organisations;

• solicitors acting on behalf of a party in relation to a sale or transaction;

• courts and tribunals to manage tenancy breaches, claims, VCAT proceedings or insurance claims;

• professional advisors and consultants (such as legal, insurance and financial advisors).
Funders of services, insurers or credit reporting bodiesWe may share your personal information with:

• financial institutions for payment processing;

• credit-reporting bodies or debt-collection agencies;

• our insurers;

• law enforcement agencies where required.
Corporate restructureWe may share your personal information with third parties, whether affiliated or unaffiliated, for the purpose of facilitating or implementing a
transfer or sale of all or part of our assets or business or if we undergo any other kind of corporate restructure, acquisition or sale. In this context, your personal information may be transferred to another entity (or if such
a sale, transfer, acquisition or corporate restructure is being contemplated by us).
Government and law enforcement agenciesWe may be required by certain Commonwealth, State or Territory legislation to report information to government agencies, regulatory bodies and law enforcement agencies.

 


9. DATA QUALITY AND SECURITY

General

We take reasonable steps to:

  • make sure that the personal information that we collect, use and disclose is accurate, complete and up-to-date;
  • protect the personal information that we hold from misuse and loss and from unauthorised access, modification or disclosure, and
  • destroy or permanently de-identify personal information that is no longer needed for any purpose permitted by applicable information protection principles.

You can help us keep your information up-to-date by letting us know about any changes to your details, such as your address, email address or phone number.


Security

The steps we take to secure the personal information we hold includes website protection measures (such as firewalls and anti-virus software), security restrictions on access to our computer systems (such as login and password protection), controlled access to our premises, policies on document storage and security, personnel security (including restricting access to personal information on our systems to staff who need that access to carry out their duties), staff training and workplace policies.


Website security

While we strive to protect the personal information and privacy of users of our website, we cannot guarantee the security of any information that you disclose online and you disclose that information at your own risk. If you are concerned about sending your information over the internet, you can contact us by telephone, email or post (details under section 14 below).

If you are a registered user of our website, you can also help to protect the privacy of your personal information by maintaining the confidentiality of your username and password and by ensuring that you log out of the website when you have finished using it. In addition, if you become aware of any security breach, please let us know as soon as possible.


IP address

An IP (internet protocol) address is a number that is automatically assigned to your computer by your internet service provider when you log on. Your IP address is not linked to your personal information but we do preserve the right to use IP addresses to identify individuals who may threaten our site, services or clients. IP addresses may also be used to help diagnose problems with our website and to gather broad demographic information.


Third-party websites

Links to third party websites that are not operated or controlled by us are provided for your convenience. We are not responsible for the privacy or security practices of those websites, which are not covered by this Privacy Policy. Third party websites should have their own privacy and security policies, which we encourage you to read before supplying any personal information to them.


Data breaches

If there is any breach of your personal information, we will deal with the breach and notify you in accordance with our obligations under the Privacy Act.

 

10. HOW DO WE STORE AND PROTECT YOUR PERSONAL INFORMATION?

We are committed to protecting your personal information, and ensuring that we securely store any personal information we collect (and in accordance with applicable privacy laws). We may hold your personal information in hard copy (paper) or electronic form.

We take all reasonable steps to ensure that any personal information we collect, use or disclose is accurate, complete, up-to-date and stored in a secure environment protected from misuse, interference and loss, and from unauthorised access, modification or disclosure.

11. HOW LONG WE KEEP YOUR INFORMATION

We will only keep the information we collect about you for as long as required for the purposes set out above or as required to comply with any legal obligations that apply to us. This will involve us regularly reviewing our files to check that information is accurate, up-to-date and still required.

When we no longer require your personal information (and in accordance with any applicable laws), we will take steps to delete, destroy or de-identify that information.

 

12. ACCESS AND CORRECTION

General

Please contact our Privacy Officer (details under section 14 below) if you would like to access or correct the personal information that we hold about you. We may require you to verify your identity before processing any access or correction requests, to make sure that the personal information we hold is properly protected.


Access

We will generally provide you with access to your personal information, subject to some exceptions permitted by law. We will also generally provide access in the manner that you have requested (eg by providing copies or allowing a file to be viewed), provided it is reasonable and practicable for us to do so. We may, however, charge a fee to cover our reasonable costs of locating the information and providing it to you.


Correction

If you ask us to correct personal information that we hold about you, or if we are satisfied that the personal information we hold is inaccurate, out-of-date, incomplete, irrelevant or misleading, we will take reasonable steps to correct that information to ensure that, having regard to the purpose for which it is held, the information is accurate, up-to-date, complete, relevant and not misleading. 

If we correct personal information about you, and we have previously disclosed that information to another agency or organisation that is subject to the Privacy Act, you may ask us to notify that other entity. If so, we will take reasonable steps to do so, unless this would be impracticable or unlawful.


What if we do not agree to your request for access or correction?

If we do not agree to your access or correction request, or if we do not agree to give you access in the manner you requested, we will give you a written notice setting out:

  • the reasons for our decision (except to the extent that, having regard to the grounds for refusal, it would be unreasonable to do so); and
  • available complaint mechanisms.

In addition, if we refuse to correct personal information in the manner you have requested, you may ask us to associate with the information a statement that the information is inaccurate, out-of-date, incomplete, irrelevant or misleading, and we will take reasonable steps to do this in such a way that will make the statement apparent to users of the information.


Timeframe for access and correction requests

Except in the case of more complicated requests, we will endeavour to respond to access and correction requests within 30 days.

 

13. COMPLAINTS

We take customer satisfaction very seriously. If you have a complaint about how we have collected or handled your personal information, please contact us (details under section 14 below).

If you make a complaint about privacy, the following will occur:

4.In most cases, we will respond to your complaint within 30 business days from when we receive your complaint. If the matter is more complex or our investigation may take longer, we will let you know.

If you are not satisfied with our response to a complaint, or you consider that we may have breached the Privacy Act (including the Australian Privacy Principles), you are entitled to make a complaint to the Office of the Australian Information Commissioner (the Australian privacy regulator).

We may make changes to this Privacy Policy, with or without notice to you. However, where we make a material change to the Privacy Policy, we will provide notice to you (including by updating our websites, and, where appropriate, notifying you directly). We recommend you visit this Privacy Policy regularly to keep you up to date with any changes we make.
